BizMiner Browse-and-Select Subscription Terms and Conditions of Use

The Brandow Company Inc. [BizMiner] offers BizMiner Browse-and-Select Subscriptions to businesses and individuals who conduct in-house research or who plan to use BizMiner data in reports or projects for clients.

Permitted Use:  Browse-and-Select Subscription Holders are permitted unlimited use of reports and data within the subscribing organization, and may use each report, or data from it, with one end-user client.

Examples of prohibited use: No-charge distribution beyond one end user client; re-sale to more than one end user client; distribution of BizMiner report content at educational, marketing or other quasi-public or by-invitation public events; any electronic or other posting on a web site or in any other electronic format aside from individual transmission to one end user client per report. Otherwise, data re-sale or re-engineering, web or electronic-based commerce or distribution to anyone outside your organization is not permitted under any BizMiner Browse-and-Select Subscription.

By purchasing a Browse-and-Select Subscription, the Browse-and-Select Subscription Holder agrees that BizMiner will assess per report charges (in addition to the one-time fee) on the credit card used for purchase. The applicable per report charge is reflected on www.bizminer.com/subscription.asp and varies with the option you selected as reflected in your purchase receipt. Per report charges will be in effect for the Browse-and-Select Subscription Holder account for the duration of the selected Plan. However, Browse-and-Select Subscription per-report discounts may be cancelled by BizMiner if the Browse-and-Select Subscription Holder fails to pay the applicable per-report costs when charged by BizMiner.

Reports purchased under Browse-and-Select Subscriptions cannot be combined with other discounts.

Your credit card will normally be charged monthly for report purchases due under the Browse-and-Select Subscription you select. However, BizMiner may from time to time charge your card on an interim basis for accrued reports purchased.

The Browse-and-Select Subscription Holder agrees to maintain an active credit card for monthly charges to BizMiner, which shall be the credit card used with the original purchase, unless the Browse-and-Select Subscription Holder promptly notifies BizMiner in writing of new card information which may be substituted. In the event that accrued charges cannot be made by BizMiner against a valid card provided by the Browse-and-Select Subscription Holder, BizMiner reserves the right to close access to the Browse-and-Select Subscription Holder account until valid card information is submitted and tested, without affecting BizMiner's right to recover the full amount due under the Browse-and-Select Subscription. In the event that collection procedures are initiated, the Browse-and-Select Subscription Holder agrees to pay any additional costs of collection and legal services deemed necessary by BizMiner for that purpose.

The Browse-and-Select Subscription Holder is responsible for maintaining security of the Browse-and-Select Subscription Holder account username and password, and is responsible for activity and charges incurred by any persons using the username and password to log into the Browse-and-Select Subscription Holder account. If the Browse-and-Select Subscription Holder feels that a username and password have been compromised, it is Browse-and-Select Subscription Holder‘s responsibility to change the username and password on the account immediately and contact BizMiner regarding any perceived unauthorized use.

Browse-and-Select Subscriptions cannot be cancelled or revised once purchased, except at BizMiner's sole discretion. If you purchase a Browse-and-Select Subscription AND DO NOT ACCESS ANY REPORTS, we will refund a portion of your fee IF within 24 hours you notify us in writing, through the contact form at http://www.bizminer.com/contact.asp that you wish to cancel. In that event, YOU AGREE that we will refund you subscription fee LESS 5% OR $30 of the total fee, whichever is greater.

Engaging in prohibited use of content constitutes a breach of the Browse-and-Select Subscription and may result in cancellation and recovery of damages by BizMiner caused by such prohibited use, including but not limited to electronic re-publication or distribution of content to third parties who are not bona fide clients of the Browse-and-Select Subscription Holder.

YOU AGREE that there are no other refunds on Browse-and-Select Subscription fees or on reports purchased through a Browse-and-Select Subscription. The initial Browse-and-Select Subscription Fee secures your right to the corresponding discount on covered report series for the duration of the subscription option you select. The initial Volume Discount Fee is non-refundable whether or not reports are accessed during your Browse-and-Select Subscription period.
